Which personal data are processed by us? And for what purposes?
We process the data you have sent us in connection with your application. This may include general information about you (such as your name, address and contact details), information about your professional qualifications and schooling or information about professional training or other information you provide us in connection with your application. Your personal data will only be collected, processed and used for the purpose of processing your application.
What is the legal basis for the processing?
The legal basis for the processing of your personal data in this application procedure is primarily Section 26 of the German Federal Data Protection Act (BDSG), effective from May 25th 2018. It allows the processing of data required in connection with the decision to establish an employment relationship. Should the data be necessary for legal prosecution after completion of the application procedure, data may be processed on the basis of the requirements of Art. 6 GDPR, in particular to safeguard legitimate interests pursuant to Art. 6 (1) (f) GDPR.
How long is the data stored?
We adhere to the principles of data avoidance and data economy. We process and store your personal data only as long as it is necessary to carry out the application process.
If you are not recruited and you do not expressly request us to delete your data, your application documents and all personal data will be deleted in accordance with the applicable legal provisions, generally no later than six months after receipt of the letter of refusal. This does not apply if the processing and storage of your personal data is necessary in a specific case to assert, exercise or defend legal claims (duration of a legal dispute).
In the event that you have consented to further storage of your personal data, we will transfer your data to our applicant pool. The data from the applicant pool is automatically deleted after one year. If you are recruited, Bauhaus Luftfahrt will copy your complete application documents into the personnel files and process them in accordance with the statutory provisions and within the framework of operational requirements.
To which recipients are the data transmitted?
For the application process, we use the "d.vinci" application portal of d.vinci HR-Systems GmbH, Nagelsweg 37 - 39, 20097 Hamburg, Germany (https://www.dvinci.de), which is integrated into our website. The company d.vinci acts as a service provider for us and may also obtain knowledge of your personal data in connection with the maintenance and servicing of the systems. We have concluded a so-called “Data Processing Agreement” with this provider, which ensures that the data processing is carried out in a permissible manner.
Your application data will be reviewed by the Bauhaus Luftfahrt HR department after receipt of your application. Suitable applications will then be forwarded internally to the department managers responsible for the respective open position. Within the company, only those persons have access to your data who need it for the proper conduct of our application process.
Your information will be treated strictly confidential.
As a rule, the data will not be passed on to third parties. In exceptional cases, your data will be forwarded if:
- you have given your express consent,
- the processing is necessary to process a contract with you,
- the processing is necessary to fulfil a legal obligation,
- the processing is necessary to protect legitimate interests and there is no reason to believe that you have an overriding legitimate interest in not disclosing your data.
Where is the data processed?
The data is processed exclusively in data centres in the Federal Republic of Germany.
Do we intend to transfer the data to a third country?
We do not intend to transfer the data to a third country.
What rights do you have?
As an applicant, you have the following data protection rights, depending on your individual situation, which you can exercise by contacting us or our Data Protection Officer at any time:
- right to information about your data stored by us and their processing,
- right to rectification of inaccurate personal data,
- right to deletion of your data stored by us,
- right to restriction of data processing if we are not yet allowed to delete your data due to legal obligations,
- right to object to our processing of your data.
If you have given us your consent, you can revoke it at any time with effect for the future.
You may lodge a complaint with the competent supervisory authority at any time if you believe that the processing of your personal data is not lawful. Your competent supervisory authority will depend on the federal state where you reside, your place of work or the place of the alleged infringement. Information on your right of objection in accordance with Art. 21 of the General Data Protection Regulation (GDPR)
You have the right to object at any time for reasons arising from your particular situation to the processing of personal data concerning you, which shall be carried out on the basis of Art. 6 (1) (f) GDPR (data processing on the basis of a balance of interests); this also applies to any profiling based on this provision within the meaning of Art. 4 (4) GDPR. If you object, we will no longer process your personal data, unless we can demonstrate compelling legitimate reasons for the processing, which outweigh your interests, rights and freedoms, or the processing serves to assert, exercise or defend legal claims. The objection can be made in any form and should be addressed to the Data Protection Officer of Bauhaus Luftfahrt.
Is there an obligation for you to provide data?
There is no legal or contractual obligation to provide applicant data. In the context of your application, you should only provide personal data that is necessary for the execution of the application. Without this information, however, we will unfortunately not be able to consider you in our application process.
Changes to this Privacy Policy
We reserve the right to make changes to this Privacy Policy so that it corresponds with the current legal requirements, or to ensure that changes, such as the introduction of new services, are implemented in our Privacy Policy. The new Privacy Policy will be valid the next time you visit our website.
